Jindal Steel Limited - Challenge to the demand of INR 153 crores on the issue of supply of infirm power in FY 2011-12 and FY 2012-13

Khaitan & Co advised and successfully represented the Jindal Steel Ltd (“JSL”) in contesting the demand of INR 153.55 Crores sought by the Chhattisgarh State Power Distribution Company Ltd.

In the Writ Appeal No. 379 of 2026, JSL had challenged the judgment / final order dated 30.03.2026 passed by the Ld. Single Judge in Writ Petition (C) No. 1927 of 2016, wherein Ld. Single Judge had dismissed the said Writ Petition by JSL challenging the demand of INR 153.5 crores by the Chhattisgarh State Power Distribution Company Limited ("CSPDCL") in 2016. CSDPCL had raised the said demand on the purported basis of the Orders / Judgments passed by the Chhattisgarh State Electricity Regulatory Commission ("CSERC") and Appellate Tribunal for Electricity ("APTEL"). However, JSL contended that said regulatory authorities nowhere expressly directed CSPDCL to recover the monies from JSL which were paid to JSL under a concluded contract and also that JSL was not a party to any of the proceedings either before CSERC or APTEL. Therefore, the alleged demand is unsustainable in law as well as there has been breach of principles of natural justice.
