SKS Ispat & Power Limited - Coal Block Cases

Represented and successfully defended SKS Ispat & Power Ltd and its directors before Special Judge (PC Act) (CBI) (Coal Block Cases), Rouse Avenue District Court, New Delhi in a criminal case registered by CBI alleging that the company and its promoters / directors criminally conspired and misrepresented to the screening committee under the Ministry of Coal and obtained allocation of coal block in favour of SKS Ispat & Power Ltd.

The Special Judge after considering the submissions of the prosecution and the defense acquitted the accused persons and observed that as regards the Charge of Section 420, IPC, the evidence adduced on record was highly insufficient to conclusively to establish any of the essential ingredients viz. deception, inducement, dishonest intention or wrongful gain for the alleged offence of cheating punishable under section 420, IPC.

As regards the charge of Section 120 IPC, it was held that the prosecution also failed miserably to show any prior meeting of mind amongst the accused person for the commission of alleged offence, against all accused persons.
