BackKhaitan & Co successfully represented Raymond Lifestyle Ltd (Plaintiff), who filed a suit for infringement of trademark, copyright and for passing off in relation to its well-known house mark and corporate name Raymond as well as the stylized artistic representations/works in respect thereof, against the Defendants (former franchisees of the Plaintiff) before the Bombay High Court.
The team was successful in obtaining an urgent ex-parte ad interim order against the Defendants who were unauthorisedly using the mark RAYMOND in a similar stylized representation as that of the Plaintiff. A court receiver was also appointed and successfully carried out search and seizure of infringing products from the Defendants’ premises.
The team was successful in securing urgent ad-interim protection for the trademark and copyrights subsisting in the client’s marks/works and corporate name.
