BackKhaitan & Co successfully represented Borosil Ltd (Plaintiff), who filed a suit for infringement of trademark, copyright and for passing off in relation to its registered mark and corporate name - Borosil against the Defendants before the Bombay High Court.
The team was successful in obtaining an urgent ex-parte ad interim order against the Defendants who were unauthorisedly using a mark which is identical/deceptively similar to Borosil’s registered mark. A court receiver was also appointed in the matter, who successfully carried out search and seizure of infringing products from the Defendants’ premises. The team was successful in securing urgent ad-interim protection for the trademarks subsisting in the client’s mark and corporate name.
